Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pianomania service, available at mypianomania.com("the Service"), operated by VERINO SERVICE LC, 502 4th St NW, Ste 102, Albuquerque, NM 87102, USA ("we", "us", the "Provider"). By creating an account or using the Service, you acknowledge that you have read, understood and accepted these Terms. If you do not agree, do not use the Service. In particular, by submitting a link or uploading a file, you accept these Terms and certify that you hold the rights to that content (or that it is royalty-free).
1. Description of the Service
Pianomaniais a piano-learning aid. From an audio file, a MIDI file or a link you provide, the Service generates a transcription/arrangement displayed as "falling notes" for personal practice. The Service also offers a library of public-domain pieces for educational purposes. The Service is a transcription and study tool; it does not provide files of protected works.
2. Eligibility
You must be at least 16 years old (or the age of digital majority in your country) to use the Service. Minors must obtain the consent of a parent or guardian. By using the Service, you represent that you meet these conditions.
3. Account
An account is required to generate tutorials. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity carried out from your account. Notify us immediately of any unauthorized use.
4. Your content — representations and warranties
You retain your rights in the content you submit (audio/MIDI files, links — "your Content"). By submitting it, you represent and warrant that:
- you hold all the rights necessary in your Content, or it is royalty-free, or you have valid authorization from the rights holder;
- you use the Service for personal, private learning purposes;
- your Content and its use do not infringe any copyright, neighboring right, trademark, or the terms of use of any third-party platform (including YouTube and TikTok);
- your Content is not illegal, defamatory, or malicious.
You grant the Provider a limited license, strictly necessary for the technical processing you request (download where applicable, conversion, transcription, display). The Provider acts as a host/technical processor of the operation you request and exercises no prior editorial control over your Content.
5. Prohibited uses
You agree not to:
- submit protected content without holding the rights or authorization;
- circumvent, disable or attempt to circumvent access limitations, the preview, quotas or the paywall;
- extract, copy, resell, redistribute or commercially exploit all or part of the Service or its library;
- use automated means (bots, scraping) to access the Service beyond normal use;
- harm the security or integrity of the Service, or violate applicable law.
6. Notice and takedown (DMCA)
If you believe that content accessible through the Service infringes your rights, write to contact@mypianomania.com specifying: the work concerned, its location, your contact details, and a good-faith statement. We will handle the request diligently and remove or disable access to the disputed content where appropriate. The author of removed content may send a reasoned counter-notification to the same address.
7. Third-party services
The Service may interact with third-party platforms (e.g. YouTube, TikTok). You are responsible for complying with their terms of use. The Provider is not responsible for these third-party services or their availability.
8. Subscriptions, payment and refunds
Full access requires a paid subscription. Payments and subscription management are handled by our provider Whop; we do not store your card data. The applicable price and billing frequency are shown before you purchase. By subscribing, you authorize recurring charges to your payment method until you cancel. Subscriptions renew automatically until cancellation. You may cancel at any time; cancellation takes effect at the end of the current period, with no pro-rata refund, except where mandatory law provides otherwise. As the Service provides digital content delivered immediately, you acknowledge that your right of withdrawal may not apply once generation has started, within the limits permitted by law. Whop's refund terms and applicable regulations prevail.
9. Intellectual property of the Service
The software, the interface, the Pianomania brand and the selection of the library remain the property of the Provider or their respective authors. Works in the library that are in the public domain or under open licenses remain subject to their respective licenses (with attribution where required). You are granted a personal, non-exclusive, non-transferable right of use, limited to the duration of your subscription.
10. Indemnification
You agree to indemnify, defend and hold harmless the Provider, its officers and providers against any claim, loss, damage or expense (including reasonable attorneys' fees) arising from your Content, your use of the Service or your breach of these Terms or of the law.
11. No warranty
The Service is provided "as is" and "as available", without warranty of any kind. Automatic transcription may contain inaccuracies and some sources may be unavailable. We do not warrant availability, accuracy or fitness for a particular purpose.
12. Limitation of liability
To the fullest extent permitted by law, the Provider's total liability in respect of the Service is limited to the amount you actually paid during the twelve (12) months preceding the event giving rise to liability. The Provider shall not be liable for indirect, incidental or consequential damages (loss of data, profits, etc.).
13. Suspension and termination
We may suspend or terminate your access, without notice, in the event of a breach of these Terms, fraudulent use, or a legal requirement. You may close your account at any time by contacting us.
14. Changes
We may modify the Service or these Terms. In the event of a material change, we will inform you by a reasonable means. Continued use after the change takes effect constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the law of the State of New Mexico (USA), without prejudice to mandatory protective provisions applicable to consumers in their country of residence. Before bringing any formal claim, the parties agree to first attempt to resolve the dispute informally for at least thirty (30) days by contacting us at contact@mypianomania.com. Any dispute that cannot be resolved informally shall be subject to the courts having jurisdiction in the State of New Mexico (USA), again without prejudice to consumer protections that may grant you the right to sue in your country of residence.
16. Electronic communications
By using the Service, you consent to receive communications from us electronically (by email or through the Service), and you agree that electronic communications satisfy any legal requirement that such communications be in writing.
17. Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these Terms without our prior written consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control (force majeure). Section headings are for convenience only. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Provider regarding the Service.
